Welcome to AtelierParc. The terms “we”, “us” and “our” refer to AtelierParc (“AtelierParc”, “we”, “us”, “our”). We operate this website and online store (the “Site”), including all related information, content, features, tools, products and services (collectively, the “Services”) to provide you, the customer, with a curated shopping experience.

Our store is hosted on Shopify Inc. (“Shopify”), which provides us with the e-commerce platform to sell our products to you.

1. ELIGIBILITY & ACCOUNT

By using the Services, you represent that you are at least the age of majority in your jurisdiction and you have the legal capacity to enter into these Terms.

You may be asked to provide information such as your name, email address, billing, payment and shipping details. You agree that all information provided is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. PRODUCTS, MATERIALS & COLORS

We strive to display our products as accurately as possible. However:

  • Colors and appearance may vary depending on your screen/device settings.

  • Wood is a natural material; grain, tone, and minor variations are normal and not considered defects.

  • Product descriptions, pricing, availability, and finishes may be updated at any time without notice.

We reserve the right to discontinue any product or limit quantities, on a case-by-case basis.

3. MADE-TO-ORDER & CUSTOM ITEMS

Many AtelierParc products are made to order and/or customized (size, finish, design, logo, special requests). You are responsible for providing correct measurements and confirming your selections before purchase.

For custom items, we may contact you for clarification. Production may not begin until details are confirmed.

4. ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase. AtelierParc may accept or decline orders at its discretion. An order is not accepted until we confirm it (by email or order confirmation) and payment is successfully processed.

Cancellations/Changes: Because many items are made to order, we may be unable to cancel or change an order once production has started. Please contact us as soon as possible.

If we cancel or modify an order, we will attempt to notify you using the contact details provided.

5. PRICING, TAXES & BILLING

All prices are listed in [USD/CAD – choose one and keep consistent on the page] unless otherwise stated. Prices and promotions may change without notice.

Unless explicitly stated, posted prices may not include applicable taxes. For U.S. orders, you may see taxes collected at checkout depending on the destination and applicable rules.

You agree to provide valid payment information and authorize us (or our payment processors) to charge the total amount of your order, including shipping, taxes, and any applicable fees.

6. SHIPPING & DELIVERY

We ship from Montréal, Canada using carriers such as UPS/USPS/partner services depending on destination.

  • Delivery times are estimates only and are not guaranteed.

  • We are not responsible for delays due to carriers, weather, customs processing, or events outside our control.

  • Risk of loss and title pass to you upon transfer to the carrier, to the extent permitted by law.

Customs & import: If your listing states “customs fees included”, that applies only as explicitly described on that product page/checkout. Otherwise, customs duties/import taxes (if any) are the buyer’s responsibility.

7. RETURNS, EXCHANGES & DAMAGED ITEMS

  • Custom or personalized items (custom size, custom design/logo, special requests) are generally final sale, except for damage/defect.

All content on the Services (text, images, designs, graphics, logos, product photos, patterns, and arrangement) is owned by AtelierParc or its licensors and is protected by intellectual property laws.

9. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or links. We do not control and are not responsible for third-party content, tools, or websites. Your use of third-party services is at your own risk and subject to their terms.

10. SHOPIFY RELATIONSHIP

Our store is powered by Shopify, which enables us to provide the Services. However, purchases made in our store are made directly with AtelierParc. Shopify is not responsible for any aspect of sales between you and AtelierParc.

11. FEEDBACK & REVIEWS

If you submit reviews, comments, photos, or other content (“Feedback”), you grant AtelierParc a worldwide, royalty-free license to use, reproduce, publish, and display such Feedback for marketing or operational purposes, unless prohibited by law.

You agree not to submit unlawful, abusive, defamatory, or infringing content.

12. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, and non-infringement.

Some jurisdictions do not allow certain disclaimers; in that case, disclaimers apply to the maximum extent permitted.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, AtelierParc and its affiliates, partners, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill arising from your use of the Services or products.

In all cases, our total liability is limited to the amount paid for the product(s) giving rise to the claim, unless otherwise required by law.

14. INDEMNIFICATION

You agree to indemnify and hold harmless AtelierParc and Shopify (and their affiliates) from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

15. TERMINATION

We may suspend or terminate access to the Services at any time if we believe you have violated these Terms. Sections intended to survive termination will remain in effect.

16. GOVERNING LAW

These Terms are governed by the laws of the Province of Québec and the applicable laws of Canada, without regard to conflict of laws principles. You agree that disputes shall be brought in the courts located in Montréal, Québec, unless otherwise required by applicable consumer protection laws.

17. CHANGES TO TERMS

We may update these Terms from time to time by posting a new version on the Site. Continued use of the Services after changes means you accept the updated Terms.
